1. About LunarKittyShop

LunarKittyShop is operated by Hugo Birner, an individual conducting business from:

In these terms, “we,” “us,” and “our” mean Hugo Birner trading as LunarKittyShop. These terms cover consumer purchases of our clothing and cosplay products and use of our online store.

Shopify provides our commerce platform. Your purchase contract is with LunarKittyShop.

These terms should be read alongside our Shipping Policy and Return and Refund Policy, made available before purchase. Mandatory consumer rights apply regardless of anything stated in our policies.

2. Placing an order

Before submitting an order, review your selected products, sizes, quantities, contact information, delivery address, and total price. Correct any errors before completing checkout.

You must have the legal capacity required to make the purchase. Where applicable law requires parental or guardian consent or representation, that requirement must be met.

We send an electronic acknowledgment after your order is submitted.

3. Products and descriptions

We aim to describe products, materials, included accessories, and sizing accurately. Please review the product description and relevant size information before ordering.

Colours may appear slightly different depending on your display. This does not excuse a materially inaccurate description, an incorrect item, or a defective product.

If you need clarification about a product, contact us before ordering. Our descriptions and any binding information supplied before purchase remain part of our obligations to you.

4. Prices and payments

The applicable currency, product prices, discounts, taxes, and delivery charges are disclosed before you place your order. Where the law requires taxes or other unavoidable charges to be included in displayed prices, those requirements apply.

Available payment options are shown at checkout and include PayPal, payment cards, and enabled accelerated checkout options such as Apple Pay and Shop Pay.

You must be authorized to use the payment method you provide.

We may correct errors in listings for future purchases. If an error affects an existing order, we will contact you and resolve it in accordance with applicable law. 5. Shipping and delivery

Orders are dispatched from China.

Our normal processing estimate is 1–5 business days, starting from [CONFIRMED PROCESSING START EVENT]. Estimated delivery is 2–3 weeks after dispatch.

These are estimates, and any more specific delivery commitment agreed for your order remains applicable. Delivery estimates do not remove your rights if we fail to dispatch or deliver as agreed.

Our standard shipping charge is $5. Standard shipping is free when the merchandise subtotal is $15 or more after discounts and before taxes.

For these shipping rates, “$” means [DOLLAR CURRENCY]. Any conversion or different currency presentation must be explained before you order.

Available destinations and shipping options are shown before purchase. Tracking information will be provided where available for the selected shipping service.

LunarKittyShop is responsible for customs duties, import taxes, and carrier clearance or handling fees associated with delivery of your order. If a carrier asks you to pay one of these charges, contact us so we can arrange payment or reimburse an amount for which we are responsible.

If we become aware that we cannot meet a promised dispatch or delivery time, we will notify you and provide the revised information and cancellation or refund options required by applicable law. We will obtain agreement to a delay where required.

For a missing, damaged, or incorrect delivery, contact us directly. Our obligations do not end merely because we handed your parcel to a carrier.

6. Cancellation before dispatch

You may cancel your order before it is dispatched by emailing lunarkittybrand@gmail.com. Include your order number or other information that allows us to identify the purchase.

A cancellation received before dispatch will be honoured even if processing has already started.

For a cancelled order, we refund the payments owed to you, including delivery charges that no longer apply, without unnecessary delay and within the applicable legal deadline. If payment has only been authorized, we arrange cancellation of the authorization where possible.

If your order has already been dispatched, you may still exercise the return or statutory withdrawal rights that apply to your purchase.

The pre-dispatch cancellation option does not replace or shorten any statutory cancellation right. Refunds required because of shipment delays or non-delivery may have shorter legal deadlines than ordinary returns.

7. Returns, exchanges, and refunds

For ordinary clothing and cosplay returns, notify us within 14 calendar days after delivery. You then have a further 14 calendar days to send the goods back.

For an order delivered in separate shipments, the notice period starts the day after the last product arrives.

Customers pay ordinary change-of-mind return postage to our Swiss return address. We cover reasonable return postage for faulty, transit-damaged, or incorrect items.

We charge no restocking fee and no refund-processing fee.

Direct exchanges for another size or style are available when stock permits. Any price difference or replacement delivery charge will be explained before you agree to the exchange. If the replacement is unavailable, you may choose a refund under our Return and Refund Policy.

The detailed return conditions, refund calculation, payment method, and refund timetable are set out in that policy. Any mandatory legal requirement giving you additional protection takes precedence.

8. Faulty goods and our responsibilities

We are responsible for supplying goods that meet the contract and applicable legal requirements.

If an item is faulty, incorrectly supplied, damaged in transit, or materially different from its description, contact us. Depending on applicable law and the circumstances, your remedies may include repair, replacement, a price reduction, or a refund.

The ordinary 14-day return period does not limit these statutory remedies. Responsibility for fulfilling our obligations remains with us when suppliers or delivery partners assist with your order.

These terms do not impose a purchase-price cap on our liability or exclude responsibility for fraud, gross negligence, personal injury caused by negligence, or liability arising from mandatory consumer protections. Our other responsibilities are determined by applicable law.

9. Customer accounts and acceptable use

If you create an account, provide accurate information, keep your access credentials secure, and contact us if you suspect unauthorized use.

Do not use the store for fraud, impersonation, unlawful activity, attempts to access another person’s information, or interference with the store’s security or operation.

We may proportionately restrict access where reasonably necessary to address a security threat, fraud, or a serious breach of these terms. Account restrictions do not remove your rights relating to existing purchases, refunds, or complaints.

10. Website content

Rights in photographs, text, designs, trademarks, and other content remain with their respective rights holders.

You may use content as permitted by applicable law. Other uses of protected content require permission from the relevant rights holder.

LunarKittyShop does not acquire ownership of third-party characters, brands, or other intellectual property merely by displaying related products.

11. Privacy and marketing

Our Privacy Policy explains how personal information is collected and used.

Accepting these terms does not constitute blanket consent to marketing or all forms of personal-data processing.

We send optional product-marketing emails when you opt in. You may unsubscribe from marketing messages. Necessary order and customer-service communications are handled separately.

12. Complaints, applicable law, and courts

Please send complaints to lunarkittybrand@gmail.com, including information identifying your order and explaining the issue.

Contacting us does not prevent you from exercising legal remedies, contacting a consumer authority, or bringing proceedings where permitted by law.

The law governing a purchase is determined by the applicable rules for domestic and international consumer contracts. Where those rules protect you under the law of your country of habitual residence, those protections remain available.

These terms do not require all disputes to be brought exclusively in Switzerland or require compulsory arbitration. You may use any court or dispute-resolution route available to you under applicable law.

13. Changes to these terms

Updated terms apply to future purchases from their stated effective date. We do not retrospectively change the terms governing an existing purchase without a lawful basis or your agreement where required.

Changes affecting an ongoing customer account will be communicated where required. Continued account use does not retrospectively change an existing purchase contract.

If a provision is found unenforceable, it will not bind you to that extent. The remaining provisions continue only where doing so is lawful.
